JH charged in a multi-million dollar conspiracy to commit tax and identity fraud.  Matthew J. Kluger files motion to dismiss arguing double jeopardy.

JR charged with murder after shooting individual multiple times.  Faced possible sentence of 25 years to life in prison.  Kluger argues to the jury that evidence demonstrated that shooting was justified because victim fired at JR first.  After three-week jury trial, defendant is acquitted of all charges and released from jail.

Supreme Court, New York County 
RP charged with assault and attempted murder.  Faced up to 25 years in prison.  After continued prosecutorial delay, Kluger files motion to dismiss based on violation of RP's right to a speedy trial.  Motion granted, case dismissed.

AH was charged with weapons possession after police recovered a loaded firearm from the glovebox of his car.  Defendant faced possible sentence of 5-15 years in jail and deportation.  Kluger files motion to suppress arguing that the defendant's Fourth Amendment rights were violated and that the gun should be suppressed.  Motion granted, gun suppressed, charge dismissed.Read the Opinion

KB charged in money laundering scheme related to drug and weapons conspiracy.  Based on defendant's unique personal circumstances, Matt Kluger persuades court to reject recommended jail sentence in favor of six-months house arrest.
NOT GUILTY
Supreme Court, Bronx County
ES charged with Murder after victim dies from multiple stab wounds following altercation at work. Faces possible life sentence and deportation.  Matt Kluger argues to jury that deceased was initial aggressor and defendant acted in self-defense.  Jury finds defendant not-guilty on all counts.  Defendant released from jail and goes home to family. 
CASE DISMISSED

JF charged with armed robbery after being pointed out to police on a crowded subway platform.  JF has no criminal record but faces a possible 25 year sentence.  Kluger argues that JF is victim of misidentification.  Case dismissed prior to jury selection.

KM was charged in 25-defendant narcotics and weapons conspiracy.  He faced a mandatory minimum fifteen-year prison sentence.  Matthew J. Kluger was able to persuaded prosecutors to dismiss the case against his client based upon insufficient evidence.
REDUCED SENTENCE
Supreme Court, Bronx County
During a struggle with his mother's abusive boyfriend, the individual fell and died.  EC was charged with Murder and faced a possible sentence of 25 years to life.  Following jury selection, Matt Kluger was able to obtain a plea offer from the prosecutor of 2 to 7 years in prison which EC accepted thus avoiding the risk that he could spend the rest of his life in jail.Read

HOMICIDE CASE DISMISSED

RA was arrested in California in 2007 and extradited to New York to stand trial for allegedly participating in a 1988 Bronx homicide. After a hearing, Matt Kluger successfully argued that RA's due process rights to a prompt prosecution were violated and that accordingly, all charges must be dismissed.Read

CHARGES DISMISSED
Federal District Court, SDNY, Manhattan
YB, a NYC "head-shop" owner was charged under the federal Controlled Substance Analogue Act with distributing designer drugs commonly known as "bath-salts." He faced a lengthy jail sentence if convicted.  After filing legal papers challenging the constitutionality of the charge, Mr. Kluger was able to persuade the Government to dismiss the contolled substance offense and allow the defendant to plead guilty to the less serious offense of product misbranding.  YB was sentenced to probation.Read the press accounts.
